2. Scope

These terms apply to every Blue Hair Labs service: website creation and redesign, logos, online shops, local visibility, AI assistants and solutions, tool installation, care plan. They apply to business and private clients alike; the rules specific to private clients (consumers) are marked. The signed quote and these terms form the contract; where they differ, the quote prevails.

Prices are in euros. VAT not applicable, art. 293 B of the French tax code: the price shown is the price paid. “From” prices on the site are indicative; only the quote is binding. Third-party services (shop platform subscription, domain name, AI API key…) are paid by the client where the quote says so.

7. Content supplied by the client

The client warrants that it has the right to use the texts, photos, logos and trademarks it supplies, and that they comply with the law. It remains responsible for the information published on its site (prices, opening hours, its company’s legal notice…).

8. Delivery and acceptance

A working version is presented to the client, who has 15 days to approve it or ask for corrections within the scope of the quote. Without an answer within this period, the service is deemed accepted. Requests outside the quote get an additional quote.

10. Third-party services

Some services rely on third parties: hosting (Cloudflare), shop (Shopify or similar), artificial intelligence (Anthropic), domain registries, email sending. Where the quote provides for it, they are subscribed in the client’s name and at its cost. Blue Hair Labs is not liable for their outages or changes of terms, but helps the client deal with them.

11. Right of withdrawal (private clients)

A private client ordering at a distance or off-premises has 14 days from the order to withdraw, without giving a reason (art. L221-18, French consumer code), by writing to [email protected]. Sums paid are refunded within 14 days. If the client expressly asks for the service to start before this period ends and then withdraws, it pays for the part already performed (art. L221-25). There is no right of withdrawal for a service fully performed with the client’s agreement before the period ends.

12. Mediation (private clients)

In case of dispute, a private client may use a consumer mediator free of charge (art. L612-1, French consumer code), after a written complaint left unresolved. Consumer mediator: being appointed. The European online dispute resolution platform may also be used.

13. Liability

Blue Hair Labs has an obligation of means: it applies its expertise to reach the result described in the quote, without guaranteeing a commercial result (Google ranking, number of customers…). For a business client, its liability is capped at the sums paid for the service concerned and excludes indirect damage (lost turnover, data not backed up by the client…). These limits do not apply to private clients beyond what the law allows.

14. Force majeure

Neither party is liable for a delay or failure caused by force majeure within the meaning of article 1218 of the French civil code. Deadlines are then suspended.

15. Personal data

The client’s data is used to perform, invoice and follow up the service. Invoices are kept for 10 years, as the law requires. The other rules are set out in the privacy policy. Where Blue Hair Labs processes data on the client’s behalf (forms, the assistant on its site), it acts as a processor under the GDPR and says so in the quote.

16. Governing law and disputes

These terms are governed by French law. With a business client, any dispute not settled amicably falls under the competent court of Blue Hair Labs’ registered office. A private client may bring a case before the court of its home or any court competent under the French consumer code.
